Terms 

1.0 Introduction

Thank you for choosing to register with Acadama. Acadama is the online platform where you can search and apply to study in higher education institutions abroad and you do not have to pay agency fee. YOU PAY US NOTHING. 

The service that Acadama offers (which we’ll refer to in this document as our “Service”) requires interaction with the user, our Institutions, business partners (“Partners”) and us. These terms (which we’ll refer to as “Terms”) are designed to safeguard everyone's legitimate interests. Likewise, when we use words like “you” and “your”, we are referring to you the user of the online platform.

Only users who have accepted these Terms will be able to access and use the Website or our Services.

All of these Terms apply to everyone who wishes to register to use the Website and when you complete your registration by accepting these Terms, there will be a legal contract between you and us.

2.0 Your Registration

We will need some basic information from you in order to complete your registration through our Website. In order to create an account with Acadama we will need your full name, your email address and you will also be asked to set a password for your account. It is your responsibility to ensure that you do not share these login credentials with any other users and keep your account secure at all times.

In completing your registration, you confirm that the information you are providing to us during the process is accurate and up-to-date. You can change these details later by accessing your settings on the Website or by contacting us by email, as applicable.

By completing the registration process you warrant to us that you have read and accepted these Terms as upon acceptance you are entering into a contract with us and that contract is based upon them. If you register and subsequently decide not to use our Service, there’s nothing you are required to do (and if you wish, you can have your registration terminated). 

We may change these Terms and if we do so, we will contact you to let you know that the Terms are to change, what those changes are and when the changes will come into effect. If you continue to use our Services after that, you will do so having accepted the new version of the Terms.

Once you’ve registered with Acadama, you’ll have access to all the features and functionality of the Website enabling you to fully interact with our Institutions and our other Partners.

3.0 You

You will provide us information in order for your registration to be effective. That information will be handled in accordance with our Privacy Notice, which forms part of these Terms and thereby, our contract with you. We must be able to identify you as an individual from the information contained within your profile and to that extent, you confirm that your profile information is accurate and that you will keep it up to date. Our Privacy Notice is available to view at any time by visiting our Website and you should make sure that you have read and accepted this prior to your acceptance of these Terms.

Our contract with you is subject to the exclusive jurisdiction of English courts and is governed by English law. You must be at least 18 years of age or if you are under the age of 18 years of age then you may use our Services but only with the permission of a parent or guardian.

You may not transfer or sell your rights under this contract to anybody else nor may you use it as security for anything. We may, for some reason have to ‘assign’ the contract that we’ve formed with you to another business (for example, as part of a restructure or if we are acquired by another company) and so we have the right to do that, but we will let you know in advance of any such ‘assignment’.

You can terminate your registration at any time by visiting our Website. The DPA and the GDPR grants you rights as a Data Subject and should you wish to exercise any of these rights there is more about this in the Privacy Notice so please follow the instructions there.

We may terminate your account if, at our discretion, we consider it to have become inactive. Generally, this will be where you have not used Acadama for a year or so, but it may be less and there may be other factors we take into account.

4.0 Us

We reserve the right under these Terms to add or remove functionality and features at any given time. We will do our best to give you some advance notice of this but from time to time, it might not be possible. We reserve the right to decide what’s best in the circumstances. We make no warranties to you that use of the Website and our Service will be uninterrupted or error free.

As Website registered user you are protected by English Law liability for personal injury or death arising from our negligence, or for any loss you suffer as a result of our fraud. 

We will not be liable to you or to any third party for any indirect or consequential loss, damage or expense (including loss of profits, data, business or goodwill) that you might suffer as a result of using the website or our service, however that loss damage or expense might arise.

In addition, we will not be liable or responsible for any failure to perform or for the delay in the performance of any of our obligations under these terms that is caused by events that are beyond our reasonable control. This might include a failure of a mobile phone network or Wi-Fi network to deliver notifications or emails to you that provide you with the ability to access the Website and the Services.

We exclude liability for any virus infection or other harm caused to your systems through your use of the website, any content downloaded via the website or when following any links to websites run by other people.

If we happen to make a statement that turns out to be untrue (whether orally or in writing) prior to your registration, then, unless that statement was made fraudulently by us, we will only be liable to you should that untrue statement result in us breaching these Terms. If it does not, the untrue statement has no impact on our relationship with you save insofar as it may impact on your legal rights as a consumer.

This Website and the Service are designed for use and are operated by Acadama in the United Kingdom. We make no warranties or representations that use of the Website and our Service is lawful or available for use in any jurisdictions beyond the United Kingdom. If you choose to access the Website and therefore our Services outside of the United Kingdom you are responsible for compliance with all local laws and regulations of your country.

These limitations and exclusions of liability will survive the termination of your registration (which, in turn, would terminate our contract with you).

You own the intellectual property rights in your profile and any content you upload, we own the framework and content that makes up the Website and our Services. That includes all the ‘copy’, the code, the look and feel and the trademarks and graphics and you can use all of that in making use of your registration in accordance with these Terms but absolutely no more than that. 

5. Applying with Acadama

Acadama is a platform that allows you to apply to Institutions through the Website. Before you apply you will need to select the course and the Institution(s) that you are applying to. It is at this point where you will be required to upload selected documents and information to supplement your application. All this information will be handled in accordance with our Privacy Notice and the ‘You’ section above.

The Institutions that we work with have access to our Website and once your application has been submitted to them, they will correspond with you directly or through the Website. We therefore exclude liability for any act or omission made by an institution through their use of our website.

AT NO POINT ARE YOU ABLE TO MAKE ANY PAYMENTS THROUGH THE WEBSITE AND ALL PAYMENTS SHOULD BE MADE DIRECTLY TO AN INSTITUTION SUBJECT TO YOUR ACCEPTANCE OF AN OFFER FROM THEM.

6. Extra Services

As an organisation we are constantly looking to expand and develop the range of Services that we offer to users of our Website through Partners. The services may include, but not limited to, help as immigration advisory and academic tutor support in your chosen place of study.

We exclude liability for any act or omission made by a partner through their use of our website.

7. This Contract

From time to time, we will give you information relating to your use of our Services. We will send this information to you in the form of notifications to the email address you have given us when registering (which is why we need you to keep that email address up-to-date). 

If, for some reason, you need to communicate with us for contractual purposes,

Everything relevant to our contractual relationship with you is set out either in these Terms or in the Privacy Notice. In submitting your registration and accepting these Terms, you must acknowledge that in registering to use the Website, you haven’t relied upon any statement made or promise given by us, whether stated plainly or implied from our conduct UNLESS that representation or statement is repeated either in these Terms or in the Privacy Notice. 

Your contract with us is subject to and governed by English law. Any dispute that arises from our relationship with you or your use of the Service will be subject to the exclusive jurisdiction of the courts of England and Wales.

This concludes these Terms and as soon as you check the ‘accept Terms’ box and submit your registration to the Services, you will have a binding contract with us.

1.0 Introduction

This notice sets out the basis on which any personal data we collect from you will be processed by us. Please read the following carefully to understand our views and practices regarding your sensitive information and how we will deal with it. For the purposes of the Data Protection Act (‘the DPA’) and the General Data Protection Regulation (‘the GDPR’), sensitive information includes what is defined as your ‘personal data’.

In this Privacy Notice, we seek to abide by the letter and spirit of the guidelines laid out by the UK Information Commissioner’s Office in the document ‘Privacy Notices, Transparency and Control’.

We are registered with the Information Commissioners Office under registration number A8672789. For the purposes of the DPA and in-line with the GDPR, Information Managers Ltd is the Data Controller. 2.0 What we do with your information

We will use your information to:

deliver our newsletter to you and to send you information about the services that we offer now and in the future and other related topics;

  • allow you to access the Acadama Website and to apply to our partner Institutions;
  • to deliver to you updates via email, telephone and the Website about your application; and send you information about the services we provide by other means.

We compile statistics about user trends on our Website, which are used by third party organisations to understand how users interact with businesses, brands and one another online and to advise about these things. These statistics are drawn from a dataset which does not contain any information from which you can be identified. If you register as a User of our Website then our services and any related communications will be delivered on the legal basis of the performance of a contract between us and you.

2.1 Information we collect from you, information we collect about you

We will collect and process the following information about you:

Information you give us - this is information about you that you give us by filling in forms on our Website or by corresponding with us by phone, email or otherwise. The information we require from you to sign up to our mailing list will include your full name and your email address.

To sign up and browse the courses on offer through our Website, we will require your full name and your email address. To apply to an institution through our Website we require personal data of which some will fall into the category of ‘Sensitive Personal Data’ (as defined under the GDPR). To apply we will require the following information:

  • Personal Details – your gender, full name, nationality, place of birth, residential and contact addresses, your email address, mobile number and full details of your next of kin. You may be required to verify your identification at this point by uploading a copy of your passport and your birth certificate;
  • Education & Work – details of all relevant qualifications required to complete your application, any languages that you speak and any relevant work experience. We will also at this stage ask for you to confirm whether you have any criminal convictions and enter details of any disabilities, health conditions or impairments;
  • Course Details & Immigration History – details of any current, previous or refused visa applications relevant to the country where our partner institution is based and any current, previous or refused applications to the institution you are applying to;
  • Fees & Finance – information about who will be making payment of your tuition fees, whether this be yourself, a family member, an employer or a government organisation; and
  • Extra Information – any additional information that you want to add to your application such as your CV or personal statement.

Whenever you visit our Website we may automatically collect the following information:

  • technical information - including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
  • information about your visit - this includes the full Uniform Resource Locators (URL), clickstream to, through and from our Website (including date and time), pages you have visited, page response times, download errors, length of visits to certain page and page interaction information (such as scrolling, clicks, and mouse-overs).

When you apply to a partner institution we will send your inputted data to the institutions that you have applied to as part of the service that we deliver. To learn more about how the Institution will handle your personal data you should visit their website(s) and review their own privacy notices. With your express permission we may also share your information with other trusted partners where you have indicated to us that it is ok for us to do so.

We may also disclose your information to third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Privacy Notice.

3.0 What we do to ensure the security of your personal information

We take the security of your personal data very seriously. Our approach to information security is constantly evolving and continually reviewed.

We have adopted industry best practices from both technological and business process perspectives in order to make the security of your data a key part of the way we do business. We have policies and practices in place that not only ensure our compliance under the DPA but also the GDPR, including training and adequate procedures put in place for any staff that handle or have access to sensitive information.

We may contact you via email with updates about the services that we offer or any changes that we have made to our Website.

You can opt in or out at any time by clicking the ‘Unsubscribe’ link in our emails.

Our Website may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates (including, but not limited to, websites on which our service may be advertised). If you follow a link to any of these websites, please note that these websites and any services that may be accessible through them are responsible or liable for their policies or for any personal data that may be collected through these websites or services, such as contact and location data. Please check these policies before you submit any personal data to these websites or use these services.

Your Rights

If your personal data is incorrect then you have the right to rectify this information and ensure that it is accurate and up to date. If your data is incorrect please contact us at the email address above. If you would like to have your personal identifiable information permanently deleted from our systems please contact us at admin@acadama.com.

There will be no charge made for reasonable electronic access to your information, your right to rectification or for your right to permanently delete your data from our systems.

4.0 How long we hold your information for

We regularly review what personal data we hold. If you have not accessed our services for an extended period then we will delete your personal data from our systems, but will send you an email first informing you of our intention to do so.

Any changes we may make to our Privacy Notice in the future will be posted on this page.
